PASSENGER AGREEMENT
Each passenger must date and sign the following before boarding vessel:
(1.) WAIVER OF LIABILITY
(2.) TERMS OF PASSAGE
Anyone under 18 years of age must have a legal guardian’s signature. Proof of guardianship will be asked before boarding vessel. Please return signed the Passanger Agreement to Champlain Nautical Adventures with deposit not more than 7 days after verbal booking date or reservation will be automactically canceled. If booked on day of sail Passenger Agreement will be provided and must be signed before boarding vessel.
(1.) WAIVER OF LIABILITY: It is agreed that the passenger(s) will be responsible for any damages or loss of personal property brought on board vessel or kayak and specifically acknowledges that neither Champlain Nautical Adventures, vessel or kayak owner, captain or crew shall have any liability whatsoever for the loss or damage to any personal property brought on board by passenger(s).
Passenger(s) agrees to hold harmless and indemnify Champlain Nautical Adventures, vessel or kayak owner, captain or crew, against all claims, damages, loss, legal or other fees, and liability of any kind, no matter how arising or occasioned, whether to property or persons, arising from the use of vessel and its equipment, irrespective of comparative or contributory negligence by any other persons.
Passenger(s), individually or collectively, agrees to hold harmless Champlain Nautical Adventures, vessel or kayak owner, captain and crew for any liability resulting from personal injury or death from any mishap while aboard vessel or kayak, tender to vessel or kayak or while ashore.
Passenger(s) is solely responsible for insuring that (he/she) is capable of engaging in any water activities chosen by the passenger(s) and do so at (his/her) own risk holding harmless Champlain Nautical Adventures, vessel or kayak owner, captain and crew of any responsibility or liability for accidents, injuries or death.
PASSENGER(S) ACKNOWLEDGE CHAMPLAIN NAUTICAL ADVENTURES HAVING READ AND UNDERSTOOD THIS WAVER OF LIABILITY AGREEMENT AND RELATED DOCUMENTS AND HEREBY AGREE TO BE BOUND BY THE TERMS.

(2.) TERMS OF PASSAGE: A 25% deposit is required upon reserving a sail date & time. It is agreed this date & time will be reserved for you based on a written/email agreement for a period of not more than seven days pending receipt of your deposit. A deposit is required for a guarenteed sail date & time otherwise sailing departures are on a first come first serve bases dock side.
A deposit is non-refundable except under the following circumstances. If the vessel(s) becomes unfit for sail or a written or email cancellation notice is received 15 days prior to sail date and time. In the event of severe inclement weather or the forecast of same, which necessitates the cancellation of voyage prior to sailing, the booking will be rescheduled under the same terms and conditions to next available date which are mutually agreed to. Deposits already paid will be applied to the alternate booking date. Local rain and or no wind are not conditions for cancellation. In all circumstances except if the vessel(s) becomes unfit for sail, returned deposits are subject to a $25 handling charge. Late arrival (30 minutes or later) or a no show forfeits rescheduling & deposit.
Champlain Nautical Adventures or the captain cannot be held responsible for dockage arrangements or lack of them away from port of origin. Passenger(s) shall abide by the captain’s judgment in regards to ports of call relative to weather, anchorage, safety and all other pertinent matters. In regard to this, the captain has sole authority to dictate a safe sailing itinerary during voyage. The captain shall handle the normal running of the vessel.
The Captain reserves the right to terminate or refuse the participation of any person(s) his judgment gives cause to believe that they might jeopardize the safety of him or her self and or others in any way. The use or possession aboard the vessel of any illegal drug, narcotic or contraband is absolutely and unconditionally prohibited. Any violation under this paragraph constitutes an immediate termination of passage as well as complete forfeiture of all moneys paid by passenger(s).
Minor breakdowns of equipment, machinery, electronics, rigging, sails, etc., which are not disabling to the vessel, do not constitute grounds for termination of this agreement or any portion thereof. In the event the vessel is delayed by such breakdowns or inclement weather or any other reason during term of passage or is disabled for any reason away from point of origin passenger(s) hold harmless Champlain Nautical Adventures, vessel(s) owner, captain or crew for any monetary losses or costs incurred due to missed prearranged activities or return transportation to point of origin.
PASSENGER(S) ACKNOWLEDGE CHAMPLAIN NAUTICAL ADVENTURES HAVING READ AND UNDERSTOOD THE TERMS OF PASSAGE AGREEMENT AND RELATED DOCUMENTS AND HEREBY AGREE TO BE BOUND BY THE TERMS.
